i just noticed the level req was 26 when it should be 40. or can it be really equipped at level 26 before?

It's a moot point. The Eden stuff is character bound, so if you're not high enough to do the quest, you can't possibly have the staff to equip. I do kinda wish all staves were bumped up one full tier though... it'd make nukers slightly less worthless than they presently are.
