10. Intellectual Property
Including but not limited to, all communication features of Gravity contains copyrighted material, trademarks and other proprietary information including, but not limited to, any titles, text, software, photographs, video, graphics, computer code, themes, objects, characters, character names, stories, dialog, catch phrases, locations, concepts, artwork, character inventories, structural or landscape designs, animations, sounds, musical compositions, audio-visual effects, storylines, character likenesses, methods of operation, moral rights, any related documentation, and "applets" incorporated into the Game and the entire contents of Gravity and each area contained therein are copyrighted as a collective work and exclusively owned and licensed by Gravity and protected by the copyright laws of the United States, international copyright treaties and conventions, and other laws. All rights are reserved.
Gravity owns copyrights in the selection, coordination, arrangement and enhancement of such contents. User may not in whole or in part, copy, photocopy, reproduce, translate, reverse engineer, derive source code, modify, disassemble, decompile, or create derivative works based on the Game, modify, publish, transmit, participate in the transfer or sale, create derivative works, or in any way exploit, any of the content contained on Gravity (including, without limitation, content that the Website enables you to download) without the express written permission of Gravity and the copyright owner. In the event of any permitted copying, redistribution or publication of copyrighted material, no changes in or deletion of author attribution, trademark, and legend or copyright notice shall be made. The downloading of copyrighted material from Gravity is allowed by the user expressly for the user's own personal use.
User acknowledges that Gravity and/or third-party content providers remain the owners of all materials posted on Gravity, and that the user does not acquire any of those ownership rights by downloading copyrighted materials.

Failure to comply with the restrictions and limitations shall result in immediate, automatic termination of the Account granted hereunder and may subject you to civil and/or criminal liability. [Notwithstanding the foregoing, you may make one (1) copy of the Game Client and the Manuals for archival purposes only.]


It says I may not copy without express written permission, but I may download for my own personal use.

And it seems that downloading does not exclusively mean it has to happen over a network. Technically "copying" the music from my game folder to my MP3 player could be worded: downloading the music from my computer to my mp3 player (an mp3 player IS a computer).


So these terms I agreed to, is it legal or illegal for me to take the music from my game folder and put it on my MP3 player?

As I understand it, it's a gray area because they're trying to differentiate between personal use and commercial use, rather than trying to restrict your ability to do it. VMware has similar vagueness in the terms of use for VMware Player.

In short, it's intentionally worded that way so that you could take the music and put in on your MP3 player for as long as they don't make the gray a black/white issue. However, in the event that they want to come after you in the future for something that appears to be commercial use even though it's technically personal use, they have the freedom to go after you. I am not a lawyer, though, so don't take this to be legal counsel; it's just personal opinion based on what I've gotten from other companies that have similar vagueness.

Therefore, rather than ask us, why not put in a support ticket and get the formal written consent of Gravity?

I don't see a problem with listening to game music on your mp3 player, the main issue is if people take the music for:

-use in a private server or some such
-Distribute/charge for the music
-Try to pass it off as their own creation.

As Holatuwol's said there are a lot of grey areas when it comes to copyright law, if it is for personal use or you want to make a music video, or do a remix, that would be ok to do.

if gravity didn't want you to access the mp3 files so you can listen to them on your mp3 player or what not, they would've crammed it into the data.grf file instead of putting it into a normal folder in your game directory.

Delete his post then, because it is completely incorrect and irrelevant based on my motives.

The deleted post is actually why I asked the question in this topic, because clearly no man would be able to find out.

I wouldn't even be playing this game if I didn't care about unenforceable laws, I'd be playing a different game that only exists on private servers now because Sega shut down the official servers.

If you want to get technical, it's only going to be nonpersonal use if you sell or broadcast it.
Once you put it on your computer for your own personal use, it's kinda whatever you do with it is your business until it becomes nonpersonal.

The issue was that it's a gray area because it says both that I can't copy anything at all, and that I can download for personal use.

But I guess that won't be answered any more clearly than community managers saying they think it's okay, unless I actually submit a ticket and get ahold of someone who owns the copyrighted works and is able to give out written permissions.

Your apology for offending me by getting my gender wrong is accepted.

110% of copyright laws say you can copy only for your personal use anyway. Pretty much EVERYTHING as a general rule is ok with it so long
a/ as you don't distribute, sell, take credit for etc.
b/ you OWN an original copy.

This includes games, music and movies.

What I'm saying is that otherwise MP3 players and DVD recorders would be illegal.
I don't think you'll find that the people who answer the tickets are experts in copyright law either.
