You might still have to keep your distance from the NPCs, that's probably why.

And there is alot of them so people just go upstairs

It might be a Vend Bot as well... report it regardless, it should not be possible as someone may be exploiting a bug or a bot in such a way.

vending in first floor is not allowed anymore, 2nd floor is the only place where you can vend, so yea, THERE IS A LOT of them upstairs

That guy is gonna get permabanned. He's a freaking idiot for even putting a shop in there. They fixed this crap about a month ago.

Now it's flooded by chatrooms. Before at least merchs could not vend near NPC's now the chatrooms always block Gramps. Getting around it is a pain in the a**.
